A Jefferson County judge has overruled a motion from attorneys for the Isle of Capri casino company seeking the dismissal of a breach of contract suit filed by Jefferson County.

County officials are suing Isle of Capri Casinos Inc. over the company's decision in 2001 to scrap plans to develop a casino, hotel and entertainment complex north of Kimmswick.

The suit, filed in late 2002, seeks damages of more than $10 million, with an exact amount based on projected revenues from the development.

Judge Gary P. Kramer heard arguments in the motion for dismissal June 27 and overruled the motion on July 1.

The case is set for a jury trial on Jan. 17.

Harvey J. Wolkoff, one of the attorneys representing the Isle of Capri, says the company plans to file additional motions in the case in the next few weeks.

"Isle of Capri does not believe, as a matter of law, that the county can recover lost profit," Wolkoff said....
